Pingilla Terms of Service

Introduction

The Pingilla application for Mac (the “App”) is made available to you by Cesare Forelli (“I”, “Me” or “My”) subject to these Terms of Service (the “Terms”), along with the Privacy Policy, which together form the complete agreement between you and Me regarding the App.

By downloading, accessing, or using the App, you agree to be bound by these Terms, as well as the Terms specified by Apple for the App Store, which is the sole distribution channel of Pingilla. If you do not agree with any of these Terms, please do not use the App.

These Terms supplement, and do not replace, Apple’s Licensed Application End User License Agreement, which also applies to your use of the App. These Terms are between you and Me only, not with Apple: Apple is not responsible for the App, its content, maintenance or support.


License and Use

  • I grant you a personal, limited, non-transferable, non-exclusive license to use the App on Mac computers you own or control that are signed in with your Apple Account.
  • You may not reverse engineer, decompile, modify, or redistribute the App.
  • Use the LAN Scanner and Ping only on networks and devices you own or are authorized to examine. Scanning networks without permission may be prohibited by law or by the rules of the network you are connected to, and you are solely responsible for how you use these features.
  • You acknowledge and agree that the App, the Pingilla and Pingilla Pro names, its code, design, and all related intellectual property are owned by Me and protected by applicable laws.
  • All trademarks, logos, and service marks displayed in the App are the property of their respective owners.

Third-Party Websites and Networks

  • The App sends requests to websites, devices and networks that belong to you or to third parties. You are responsible for having the right to check them.
  • I am not responsible for how those websites, devices, networks or their operators react to the App’s requests, for example by blocking your connection, rate-limiting you, or raising alerts in firewalls or intrusion detection systems.
  • I am not responsible for the content, availability or behavior of third-party websites and devices.

Not for Critical Use

  • The App checks websites and devices from your Mac, and only while your Mac is awake, connected to a network and running the App. It is not a substitute for professional, always-on monitoring.
  • You will not rely on the App in emergency, safety-critical or otherwise critical situations, nor to monitor systems whose failure could lead to death, personal injury, or severe financial, physical or environmental damage.
  • You acknowledge that the App can miss outages, report false alarms, stop or crash, and that notifications can be delayed or not delivered, for reasons that may or may not depend on the App.

Features and Purchases

  • The free version of Pingilla includes, with limits: • Site Monitor: up to 3 sites, checked every 5 minutes or less often, with 24 hours of uptime history • LAN Scanner: up to 20 devices from the latest scan of the current network • Ping: up to 20 pings per run
  • To remove these limits and unlock all features, including device memory, names, notes and tags, automatic scans and device notifications, multiple networks, port and service detection, Wake on LAN, 7- and 30-day uptime history with incidents, certificate expiry alerts, and unlimited ping, you may upgrade to Pingilla Pro, a one-time purchase (which includes Family Sharing). There is no subscription.
  • Features, pricing and availability may change.
  • All purchases are handled by Apple via the App Store. I do not process payments or store your payment details.
  • All sales are final. Refunds, if any, are subject to Apple’s policies.

Data and Privacy

  • The App stores all your data locally on your Mac; it is not synced to iCloud or to any other service, and I cannot access it.
  • The App does not include analytics or tracking.

Disclaimer of Warranties and Liability

  • The App is provided “as is” and without warranties of any kind, express or implied.
  • I do not guarantee that the App will be error-free, uninterrupted, accurate, or suitable for your particular needs; for example, device names, manufacturers, open ports and online status are determined from what devices and the network report, and may be incomplete or wrong.
  • Device manufacturers are looked up in a copy of the public IEEE registry of MAC address assignments included in the App. It is provided as is and may be incomplete or out of date.
  • All your data is stored only on your Mac. You are responsible for backing it up, for example with Time Machine or with the App’s own backup export; data loss may occur, and I cannot recover data that was never stored anywhere else. Importing a backup replaces the App’s current data; the App saves a copy of the replaced data first, but you are responsible for keeping your backups safe.
  • To the maximum extent permitted by law, I shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the App, including damages from outages the App did not detect or report.
  • You use the App at your own risk.

Modifications and Termination

  • I may update or change the App, these Terms, or the Privacy Policy at any time. Updated Terms will be published with a revised date. By continuing to use the App after changes are posted, you agree to the updated Terms.
  • I reserve the right to update the App to add or remove features.
  • While I do not currently plan to do so, I may discontinue the App at any time, with or without notice.

Applicable Law

  • These Terms are governed by Italian law.
  • Any disputes shall be resolved exclusively in the courts of Savona, Italy.
  • If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect, reflecting as closely as possible the original intent of the parties.
